Divorce under Florida Law

A petition for dissolution of marriage can be filed by either spouse, so long as a spouse has established residency in Florida for at least six months immediately prior to filing. Florida law has done away with fault-based grounds for divorce, so that the only grounds for divorce are an irretrievable breakdown of the marriage (no-fault divorce) or mental incapacity of one of the parties. Although nearly all divorces in Florida are no-fault divorce, the irretrievable breakdown of the marriage is still an essential element that must be properly demonstrated before the court can grant a divorce.

After the petition for dissolution is filed with the court and responded to by the other party, the court requires both spouses to make financial disclosures regarding assets and debts. Temporary orders may be entered at this time, such as temporary alimony. In most cases, the court will order the parties to enter mediation and try to reach agreement on any contested matters, including:

  • Prenuptial and Postnuptial Agreements

  • Mediation
