Obtaining a no-fault divorce in Florida is not especially difficult in itself, but the issues decided in the divorce can have enormous consequences for years into the future. We provide solid representation in every aspect of Florida divorce, including parenting and child support, spousal support, and the division of property. We know that former spouses, especially parents, need to have an ongoing relationship or means of communication. We strive to resolve divorce matters in your best interest with a minimum of friction and with a recognition that the parties may still need to be able to communicate with each other post-divorce.
High Net Worth
Attorney David L. Hirschberg is particularly adept at handling cases involving individuals of high net worth, and the issues unique to these types of cases. In divorces involving high assets, high stakes, or high-profile individuals, discretion and privacy may be paramount. Our firm is sensitive to these matters and takes steps to resolve matters accordingly, whether seeking to negotiate a pre-suit settlement, or seeking a more distant venue for the resolution of the case. From financial discovery to resolving contested parenting issues, you can count on the expertise at the Law Offices of David L. Hirschberg, P.A. to handle your divorce efficiently and effectively.
Although court orders made in a divorce decree are intended to be final, circumstances do arise that would justify the modification of a court order post-divorce. Court orders most often subject to modification include child support, spousal support, and parenting and timesharing. The property division, once ordered, is rarely modified later. Examples of reasons that a custody or support order may need to be modified include:
- Paying party loses job, retires or receives less income
- Receiving party cohabits with another
- Needs of child change
- Parent wishes to move out of state or a great distance away from current location
Not every change in circumstances will justify a modification; the change must be substantial, and the burden is generally on the party seeking the change to prove it is necessary. Modifications of court orders require going to court, and the other party may challenge any proposed modification. Whether seeking or challenging a modification to an existing order, the Law Offices of David L. Hirschberg, P.A. can provide knowledgeable, effective representation.
Prenuptial and Postnuptial Agreements
Any couple can benefit from having a prenuptial agreement. Both parties desire to begin this new chapter of their life with security and peace of mind that they will be treated fairly in the event of a divorce, separation or other future event. The prenuptial agreement is an excellent tool toward that end. We assist couples in drafting or reviewing premarital and postmarital agreements throughout South Florida in Palm Beach, Broward and Miami-Dade Counties.
If a child was born to parents who were unmarried at the time, paternity must either be established through voluntary acknowledgement or in a court proceeding. If paternity has not been established prior to a divorce proceeding, it can become especially important at that time. A child’s legal father can be held legally responsible to support the child financially, and may also have a legal right to share in parenting time and decisionmaking. With so much at stake, having quality legal representation is imperative. We represent clients seeking to establish or challenge paternity in Florida divorce cases or stand-alone proceedings.
In family law as well as most areas of life, a negotiated settlement is preferable to litigation. Rather than having a decision imposed on them by a judge, parties to a mediated agreement take an active role in fashioning the outcome. Mediated results are not only faster and less expensive than courtroom litigation; they are also more satisfactory to the parties and more likely to be implemented voluntarily without the need for court enforcement. Mediation has the added benefit of being a private proceeding, which is important to many who do not want to see the details of their divorce become a matter of public record. David L. Hirschberg is a Florida Supreme Court Certified Family Law Mediator who can help you find a satisfactory result to your divorce or other family law matter.
